Even if you don’t know exactly when or where a DUI checkpoint is scheduled, statistics can give you a good idea of the times they’re more likely to appear. In most cases, roadblocks occur between the hours of 9 p.m. and 2 a.m. on weekends and holidays, and in areas near bars and other locations where alcohol is widely consumed.

One of the best ways to avoid being stopped in a roadblock is to simply avoid them. However, this may not always be possible, it is important to know the DUI guidelines that law enforcement officers must follow, as failing to do so can often be grounds to appeal your arrest and fight to get your case dismissed in court.

Officers are also required to provide a valid reason for setting up a DUI checkpoint—such as a high number of drunk driving arrests or alcohol-related accidents in a particular area, for example. There must also be a specific plan regarding which vehicles will be stopped during the roadblock (every other car, every third vehicle, etc.) and any deviation from this plan must be recorded.

RAYNE POLICE DEPARTMENT: I FIRST GAVE THIS A ONE STAR BECAUSE I WAS ANGRY BUT CHANGED IT TO A 5 STAR I went to the Rayne Frog Festival for the first time, well to all who know me I wear the black western hat, yellow trunks and cowboy boots with a half shirt. I walked around the fair area where all the rides are and when I came back to the dance area I was stopped for the first time. The police said they had a complaint and wanted to know if I had underwear on, I said yes and do ya'll want to see, they believed me and said that I was not allowed back in the fair area. (It appears that people don't know the difference between short pants that go down to your knees and trucks) I was not grabbing myself, you know like Michael Jackson, nothing was sticking out and someone complains and I get restricted from that area, I wanted to ride on the ferris wheel. Sooooo, I'm looking at the competitions going on and enjoying myself, taking many pictures with people who want to take a picture with me, something I enjoy doing very much. When the music started I was dancing by myself on the dance floor and appreciated all the woman who just walked up and started dancing with me. This was going good for a couple of hours, then I gave a woman who passed by a compliment, I told her she looked good and gave her a thumbs up, sweet little suga gave me an awesome smile. A man grabs me and she pulled him off of me, I laughed it off and continued enjoying myself. About 10 minutes later a police officer comes to me and tells me I have to leave because of complaints. I assume the man who just grabbed me went complain about the compliment I gave the woman. Next time a man puts his hands on me Police Department I will knock him out for attacking me, then if they kick me out, they will have a better reason. This police officer would not listen to reason and that really SUCKS, did he question any of the many people who saw what happened NO HE DID NOT!!

TO ALL POLICE DEPARTMENTS I HONESTLY HAVE TO GIVE ALL OF YOU A 5 STAR & LAW ENFORCEMENT AGENCIES, this includes Rayne, La.!! I cannot condemn the entire police department because of one officer's action, I keep you people in my prayers morning and night. But please help me to understand, all a person has to do is go up to a police officer and say I don't like the way this person is dressed and that is a complaint. The person at the Frog Festival attacked me but this officer did not want to hear my side of the account, I was attacked and get kicked out, REALLY! I must have take over 20 pictures with people who came up to me to take a picture and I have a few posted, if there was something so wrong in what I was wearing do you think people would want to take a picture with me. I have take 100s of picture with people from all over the world. MANY THANKS TO ALL YOU OFFICERS FOR KEEPING ME SAFE, I WILL CONTINUE TO PRAY FOR YOU AND CONTINUE WITH MY ANNUAL SUPPORT TO LOUISIANA POLICE DEPARTMENT ASSOCIATION. My facebook is under joe lee!!
